DIRECTV offers an array of services (collectively, the "DIRECTV Text Messaging Services") that take advantage of the text messaging capability of your wireless phone. You may have the opportunity to send a text message for display in conjunction with enhanced DIRECTV programming, participate in polls and quizzes, or receive DIRECTV Acct alerts to help you manage your account or DIRECTV Mobile alerts providing you with news and information about DIRECTV and its service offerings.
By sending a text message for participation in our services, or by opting in to DIRECTV Mobile/Marketing alerts or DIRECTV Mobile Account Management alerts (collectively “Mobile Care”), or by otherwise using our DIRECTV Text Messaging Services, you are agreeing to these DIRECTV Text Messaging Terms and Conditions. These Terms and Conditions may change from time to time, and we will post any updates here.
The following carriers are currently supported by DIRECTV Text Messaging Services: T-Mobile®, U.S. Cellular®, Sprint, Nextel, Boost Mobile, Ntelos, Metro PCS, AT&T, Alltel, Verizon Wireless, Virgin Mobile USA, Cricket, Cincinnati Bell, and Cellular South. Additional carriers may be added as they become supported.
1. Cost of Participation DIRECTV Text Messaging Services, including Mobile Care services require no purchase or fee for participation. Unless specifically noted as free to end user, message and data rates may apply to DIRECTV Text Messaging Services, including specifically Mobile Care services and alerts and may be billed on your wireless phone bill or deducted from your prepaid balance. Check with your carrier for details. The number of messages you may receive from DIRECTV in a month will depend on your participation in services and on which Mobile Care services you have opted to receive.
2. User Conduct
You agree not to send or otherwise make available content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, or contains hate speech.
You acknowledge that DIRECTV may or may not pre-screen text message content you provide, but shall have the right, without obligation and in its sole discretion, to pre-screen, refuse, or remove any content you make available, including content that violates this section.
By opting in to a Text Messaging Service from a cellular telephone number, you are representing to DIRECTV that the cellular telephone line from which you have opted-in is one for which you can provide consent to receive text messages from DIRECTV. You agree that if and before you disconnect that phone line, you will send a STOP ALL message to each DIRECTV short code you have opted in to in order to stop future text messages from being sent to that number.
3. Rights
By sending text messages for use on a campaign, you grant DIRECTV the perpetual, irrevocable, and fully sublicensable license to use, distribute, reproduce, modify, adapt, publish, translate, publicly perform, and publicly display any and all text message content provided by you to DIRECTV (in whole or in part) and to incorporate such content into other works in any format now known or later developed.
4. Confirmation
You understand and agree that you will receive a confirmation text message for each text message, vote, quiz response or similar text message sent to a DIRECTV short code, and that confirmation text messages may offer you the opportunity to opt-in to Mobile Care services. You will never be opted in to a Mobile Care service without your permission.
5. DIRECTV MOBILE CARE: PARTICIPATING, OPT OUT, QUESTIONS
You may be offered the opportunity to opt-in for our Mobile Care services. The terms in this Section 5 relate specifically to Mobile Care services. If you do not opt-in to a Mobile Care service, then the terms in Section 5 do not apply to you.
Participating, Opting Out, or Asking Questions. You may find information about DIRECTV Mobile Care campaigns and services at www.directv.com/sms and may join particular campaigns and services of interest by entering the cellular telephone number at which you wish to receive alerts in the opt-in forms provided at our website.
All DIRECTV Mobile/Marketing campaigns use the short code 223322. To opt-in to a particular DIRECTV Mobile/Marketing campaign, simply text the keyword associated with that campaign to its short code 223322. To opt-out of a particular DIRECTV Mobile/Marketing campaign, please reply with the keyword “STOP” to a message or alert sent by the campaign from which you wish to opt out. If you would like to opt-out of all Mobile/Marketing campaigns you have previously joined, you may text "STOP ALL" to short code 223322.
All DIRECTV Mobile Account Management alerts and services use the short code 21880. To opt-in to a particular DIRECTV Mobile Account Management service, simply text the keyword associated with the service to its short code 21880. To opt-out of a particular DIRECTV Mobile Account Management service, please reply with the keyword “STOP” to a message or alert sent by the service from which you wish to opt out. If you would like to opt-out of all DIRECTV Mobile Account Management services you have joined, you may text "STOP ALL" to short code 21880.
Please note that if you opt out of Mobile/Marketing or Mobile Account Management alerts, you are only opting out of receiving mobile alerts associated with that particular service’s short code as described above. You may continue to receive alerts associated with other DIRECTV Text Messaging Services (unless you choose to opt out of such other services). You may also continue to receive telephone calls to wireless telephone numbers provided by you as contact information on your DIRECTV account..
If you experience any problems with opting out of a Text Messaging Service, or if you need help or additional information related to a specific Text Messaging Service, please text "HELP" to its short code.
Frequency of Messages. Message frequency is based on the Text Messaging Services, including Mobile Care services, in which you participate as well as account status and settings. Alerts may be sent daily, weekly, monthly, and/or at scheduled intervals depending on the campaign or service to which you have subscribed and your mobile carrier's policy.
6. Privacy Policy

7. No Guarantee
DIRECTV is not responsible for incomplete, lost, late, or misdirected messages, including (but not limited to) undelivered messages resulting from any form of filtering by your mobile carrier or service provider, and cannot guarantee that all messages received by DIRECTV for messaging campaigns will be broadcast by DIRECTV.
8. United States Only
Currently, DIRECTV Text Messaging Services are available only to residents of the United States. You understand and acknowledge that you may not sign up for, access, or attempt to access or use the DIRECTV Text Messaging Services from countries outside of the United States.
9. DISCLAIMER OF WARRANTIES
YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR PARTICIPATION IN DIRECTV TEXT MESSAGING SERVICES, INCLUDING DIRECTV MOBILE CARE CAMPAIGNS, IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. DIRECTV AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, AGENTS, EMPLOYEES, PARTNERS, AND LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
DIRECTV, ITS SUBSIDIARIES, AFFILIATES, OFFICERS, AGENTS, EMPLOYEES, PARTNERS, AND LICENSORS MAKE NO WARRANTY THAT (A) THE SERVICES WILL MEET YOUR REQUIREMENTS; (B) THE SERVICES WILL BE UNINTERRRUPTED, TIMELY, SECURE, OR ERROR-FREE; OR (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE.
10. LIMITATION ON LIABILITY
YOU EXPRESSLY UNDERSTAND AND AGREE THAT DIRECTV, ITS SUBSIDIARIES, AFFILIATES, OFFICERS, AGENTS, EMPLOYEES, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, EVEN IF DIRECTV HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICES, UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICES, OR ANY OTHER MATTER RELATING TO THE SERVICES. SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
11. Indemnification
You agree to indemnify and hold harmless DIRECTV, its subsidiaries, affiliates, officers, agents, employees, partners, and licensors, from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the DIRECTV Text Messaging Services (such as text message content you submit, post, transmit, or otherwise send to DIRECTV), including (but not limited to) claims that your content is tortious, defamatory, invasive of privacy, or violates the intellectual property rights of another.
12. Termination
DIRECTV reserves the right, in its sole discretion, to cancel or suspend any or all of its DIRECTV Text Messaging Services, including Mobile Care services, in whole or in part, for any reason, with or without notice to you.
13. Applicable Law and Disputes
These Terms and Conditions and our relationship with you regarding DIRECTV Text Messaging Services are governed by the DIRECTV Customer Agreement and expressly include Section 9, Resolving Disputes, which requires individual arbitration of disputes that cannot be informally resolved, or an individual action in small claims court in lieu of arbitration.
14. Other
If any part of these Terms and Conditions is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of these Terms and Conditions, and the remaining portions shall remain in full force and effect.
