DIRECTV offers an array of services (collectively, the "DIRECTV Text Messaging Services") that take advantage of the text messaging capability of your wireless phone. You may have the opportunity to send a text message for display in conjunction with enhanced DIRECTV programming, participate in polls and quizzes, or receive DIRECTV Mobile Alerts providing you with news and information about DIRECTV and its service offerings.
By sending a text message for participation in our services, or by opting into one of our Mobile Care services, or by otherwise using our DIRECTV Text Messaging Services, you are agreeing to these DIRECTV Text Messaging Terms and Conditions. These Terms and Conditions may change from time to time, and we will post any updates here.
The following carriers are currently supported by DIRECTV Text Messaging Services: T-Mobile®, U.S. Cellular®, Sprint, Nextel, Boost, AT&T, Alltel, Verizon Wireless, Virgin Mobile, Cricket, Cincinnati Bell, and Cellular South. To participate, your phone must be enabled for text messaging. We want everyone to be able to participate, and plan to add more carriers to this list as they become supported.
1. Cost of Participation
While our DIRECTV Text Messaging Services, including Mobile Care services, are complimentary and require no purchase or fee for participation, message and data rates may apply, and may be billed on your wireless phone bill or deducted from your prepaid balance. Check with your carrier for details.
2. User Conduct
You agree not to send or otherwise make available content that is unlawful, harmful, threatening, abusive, harassing, tortous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, or contains hate speech.
You acknowledge that DIRECTV may or may not pre-screen text message content you provide, but shall have the right, without obligation and in its sole discretion, to pre-screen, refuse, or remove any content you make available, including content that violates this section.
3. Rights
By sending text messages for use on a campaign, you grant DIRECTV the perpetual, irrevocable, and fully sublicensable license to use, distribute, reproduce, modify, adapt, publish, translate, publicly perform, and publicly display any and all text message content provided by you to DIRECTV (in whole or in part) and to incorporate such content into other works in any format now known or later developed.
4. Confirmation
You understand and agree that you will receive a confirmation text message for each text message, vote, quiz response or similar text message sent to a DIRECTV short code, and that confirmation text messages may offer you the opportunity to opt-in to Mobile Care services. You will never be opted in to any Mobile Care service without your permission.
5. DIRECTV MOBILE CARE
You may be offered the opportunity to register for our Mobile Care services. The terms in this Section 5 relate specifically to Mobile Care services. If you do not opt-in to a Mobile Care service, then the terms in Section 5 do not apply to you.
Participating, Opting Out, or Asking Questions. All DIRECTV Mobile Care campaigns use the short code 21880. To opt-in to a particular campaign simply text the keyword associated with that campaign to 2-1-8-8-0. To opt-out of a particular mobile campaign, please reply to a Mobile Care message by sending the keyword "STOP" to 21880. If you would like to opt-out of all Mobile Care campaigns, please text "STOP ALL" to 21880. If you experience any problems with opting out of a Mobile Care campaign, or if you need help or additional information related to a specific Mobile Care campaign, please text "HELP" to 21880 or email us (and include your mobile phone number) at mobileinfo@directv.com.
Frequency of Messages. Message frequency based on account settings. Alerts may be sent daily, weekly, monthly, and/or at scheduled intervals depending on the campaign to which you have subscribed and your mobile carrier's policy.
6. Privacy Policy
For additional information regarding our use of information collected through DIRECTV Text Messaging Services, please refer to our Privacy Policy.
7. No Guarantee
DIRECTV is not responsible for incomplete, lost, late, or misdirected messages, including (but not limited to) undelivered messages resulting from any form of filtering by your mobile carrier or service provider, and cannot guarantee that all messages received by DIRECTV for messaging campaigns will be broadcast by DIRECTV.
8. United States Only
Currently, DIRECTV Text Messaging Services are available only to residents of the United States. You understand and acknowledge that you may not sign up for, access, or attempt to access or use the DIRECTV Text Messaging Services from countries outside of the United States.
9. DISCLAIMER OF WARRANTIES
YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR PARTICIPATION IN DIRECTV TEXT MESSAGING SERVICES, INCLUDING DIRECTV MOBILE CARE CAMPAIGNS, IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. DIRECTV AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, AGENTS, EMPLOYEES, PARTNERS, AND LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
DIRECTV, ITS SUBSIDIARIES, AFFILIATES, OFFICERS, AGENTS, EMPLOYEES, PARTNERS, AND LICENSORS MAKE NO WARRANTY THAT (A) THE SERVICES WILL MEET YOUR REQUIREMENTS; (B) THE SERVICES WILL BE UNINTERRRUPTED, TIMELY, SECURE, OR ERROR-FREE; OR (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE.
10. LIMITATION ON LIABILITY
YOU EXPRESSLY UNDERSTAND AND AGREE THAT DIRECTV, ITS SUBSIDIARIES, AFFILIATES, OFFICERS, AGENTS, EMPLOYEES, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, EVEN IF DIRECTV HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICES, UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICES, OR ANY OTHER MATTER RELATING TO THE SERVICES.
11. Indemnification
You agree to indemnify and hold harmless DIRECTV, its subsidiaries, affiliates, officers, agents, employees, partners, and licensors, from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the DIRECTV Text Messaging Services (such as text message content you submit, post, transmit, or otherwise send to DIRECTV), including (but not limited to) claims that your content is tortious, defamatory, invasive of privacy, or violates the intellectual property rights of another.
12. Termination
DIRECTV reserves the right, in its sole discretion, to cancel or suspend any or all of its DIRECTV Text Messaging Services, including Mobile Care services, in whole or in part, for any reason, with or without notice to you.
13. Applicable Law and Disputes
These Terms and Conditions and our relationship with you regarding DIRECTV Text Messaging Services are governed by the laws of the State of California, without regard to its conflict of laws principles. You and we agree to submit to the exclusive jurisdiction of any State or Federal court located in the County of Los Angeles, California, and you and we hereby waive any jurisdictional, venue or inconvenient forum objections to such courts. Your use of the DIRECTV Text Messaging Services constitutes an agreement by you that any dispute that cannot be resolved between you and us shall be resolved without resort to any form of class action.
14. Other
These Terms and Conditions contain the entire agreement between you and DIRECTV regarding the use of DIRECTV Text Messaging Services, including Mobile Care services, and supersede all prior understandings related to use of the services. If any part of these Terms and Conditions is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of these Terms and Conditions, and the remaining portions shall remain in full force and effect.
